1. Agreement to Terms

By accessing or using our website, miniconcept.ca (the "Site"), and/or purchasing anything from us, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and must discontinue use immediately.

2. Products and Services

We offer custom flower arrangements, balloon decor, and related gifts

A. Customization and Subjectivity

Artistic Variation: Flower arrangements and balloon setups are artistic creations. While we aim to match the designs shown on the Site, please note that exact replications are impossible. Minor variations in colour, size, and specific bloom type are to be expected.
Substitution Policy: Due to the seasonal and availability nature of flowers and materials, we reserve the right to substitute materials of equal or greater value if a specific item is unavailable. We will maintain the overall style and colour palette of the intended design.

B. Pricing and Payment

Accuracy: All prices are subject to change without notice. We are not liable for any errors or inaccuracies in pricing on the Site.
Taxes: All prices listed are exclusive of applicable provincial and federal sales taxes (e.g., GST/HST), which will be added at checkout.
Payment: We accept payment via Visa, Mastercard, etc. Payment must be received in full before an order is confirmed and processed.

3. Orders, Delivery, and Risk

A. Order Confirmation: Orders are only confirmed once you receive an order confirmation email from us.

B. Delivery:

Accuracy: You are responsible for providing the correct delivery address and contact information. We are not responsible for delivery failures or delays due to incorrect information supplied by you.
Delivery Acceptance: The risk of loss and damage to the Products is transferred to the recipient upon delivery. If the recipient is unavailable, the order may be left in a safe place at the delivery address (e.g., with a concierge, on a porch). Once left, we are not responsible for theft or damage.

C. No Refunds: Please refer to our separate Refund Policy which states that all sales of flowers and balloon setups are final due to their perishable and custom nature.

4. User Representations and Prohibited Activities

By using the Site, you represent and warrant that: (1) you have the legal capacity to agree to these Terms; (2) you will not use the Site for any illegal or unauthorized purpose; (3) you will not attempt to bypass or interfere with the security features of the Site.

5. Intellectual Property

All content on the Site, including text, graphics, logos, images, and the Products' design concepts, are the property of Mini Concept and are protected by Canadian and international copyright and trademark laws. You may not use any content without our express written permission.

6. Limitation of Liability

In no event will Mini Concept, or its directors, employees, or agents, be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site or the Products, even if we have been advised of the possibility of such damages.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Any legal action or proceeding related to the Site shall be brought exclusively in the courts located in [Insert Your City/Region, e.g., Toronto, Ontario].

8. Modifications to Terms
